A RESOLUTION OF THE BOARD OF TRUSTEES OF COLUMBIA COUNTY RURAL LIBRARY DISTRICT, COLUMBIA COUNTY, WASHINGTON, CONCURRING WITH THE REQUEST OF THE CITY OF DAYTON TO ANNEX INTO THE COLUMBIA COUNTY RURAL LIBRARY DISTRICT; REQUESTING THAT THE BOARD OF COUNTY COMMISSIONERS OF COLUMBIA COUNTY CALL A SPECIAL ELECTION FOR THE PURPOSE OF PERMITTING CONSIDERATION OF THE PROPOSED ANNEXATION BY THE VOTERS OF THE CITY OF DAYTON; AND PROVIDING FOR OTHER MATTERS PROPERLY RELATING THERETO.

BE IT RESOLVED BY THE BOARD OF TRUSTEES OF COLUMBIA COUNTY RURAL LIBRARY DISTRICT, COLUMBIA COUNTY, WASHINGTON
, as follows:

WHEREAS, Columbia County Rural Library District, Columbia County, Washington (the “District”) is a rural county library district duly organized and existing under and by virtue of the Constitution and the laws of the State of Washington, specifically chapter 27.12 RCW; and

WHEREAS, RCW 27.12.360 allows a city or town with a population of 100,000 or less to become part of a rural county library district lying continuous thereto and sets forth the required procedure to effect such annexation; and

WHEREAS, the City of Dayton (the “City”), having a population of less than 100,000 and following the requirements of RCW 27.12.360 adopted Ordinance 1736 on November 22, 2005, Stating the Intent to Annex to the Columbia County Rural Library District, and Finding That the Public Interest Will be Served Thereby (a copy of which is attached as Exhibit “A” and incorporated herein by reference; and has requested concurrence by the Columbia County Rural Library District Board of Trustees (the “Board”); and

WHEREAS, the District has provided Library Services to the residents of the City of Dayton under the terms of the Interlocal Agreement for Management and Operation of the Dayton Memorial Library dated May 29th, 2007; and

WHEREAS, the District and the City have entered into an Annexation Agreement, attached as Exhibit "B", to become effective upon the approval of the voters on the proposition for the annexation of the City to the District; and

WHEREAS, the Board deems that it is in the best interests of the District to concur in the City’s annexation request; and

WHEREAS, RCW 27.12.360 requires that the Board notify the Board of County Commissioners of Columbia County (the “County Commissioners”) of its concurrence in the proposed annexation; and

WHEREAS, RCW 27.12.370 requires that the County Commissioners by resolution call a special election in the City on the proposed annexation at the next date provided in statute, but not less than fifty-two days from the date of such resolution.

NOW THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED
as follows:

Section 1: ANNEXATION CONCURRENCE
The Board hereby concurs in the City ’s request to annex into the District, under the terms set forth in the Annexation Agreement.

Section 2: NOTIFICATION OF COUNTY COMMISSIONERS
The Board hereby directs its Secretary to transmit notification of its concurrence with the City’s annexation request to the County Commissioners in sufficient time for it to meet the filing deadline for the ____________ Special Election.

Section 3: REQUEST FOR SPECIAL ELECTION
The Board hereby requests that the County Commissioners honor the request of the City of Dayton to call a special election in the City on ____________ to permit the voters of the City to consider the annexation of the City to the District as provided in RCW 27.12.370.

Section 4: EFFECTIVE DATE
This Resolution shall be effective immediately upon its adoption and approval.

Resolution 2009-2

 

RE: COMPUTER SYSTEM USAGE RESOLUTION

WHEREAS, generally the Columbia County Rural Library District computer system (including all hardware and software) are the exclusive property of the Columbia County Rural Library District and are provided for creating and transmitting business-related information, and

WHEREAS, Columbia County Rural Library District treats all computer files, including electronic mail (email, social networking sites) sent or received, as business information;

NOW, THEREFORE BE IT RESOLVED
, if the employees make incidental use of the computer system for personal files or email, employees should not expect personal files, email, social networking sites to be protected from review by other employees. Accordingly, employees should not use computer systems to create or transmit any information they wish to keep private. Personal use of computers shall be limited to breaks, lunch, or after regular office hours.

BE IT FURTHER RESOLVED, use of the computer system to engage in any communications that are in violation of this or any Columbia County Rural Library District policy, including but not limited to the acquisition, possession or transmission of defamatory, obscene, offensive, or harassing material, is strictly prohibited. Columbia County Rural Library District reserves the right to inspect any Columbia County Library computer system/equipment for violations of this policy.

Resolution 2009-3

 

RE: EQUAL EMPLOYMENT OPPORTUNITY

WHEREAS, Columbia County Rural Library District prohibits, and does not tolerate discrimination against anyone on the basis of race, color, religion, sex, age, national origin, veteran status, or disability. All employees, supervisors, administrators, and job applicants are guaranteed the same employment opportunities. No person or employee, no matter, his or her title or position, has the authority, whether expressed, actual, apparent or implied, to discriminate against another employee of Columbia County Rural Library District, and

WHEREAS, Columbia County Rural Library District will not discriminate against any employee, supervisor, administrator, or application on the basis of race, color, religion, sex, age, national origin, veteran status, or disability. Columbia County Rural Library District supervisors and/or administrators will make all recruitment, placement, selection, training and layoff decisions based solely on job-related qualifications and abilities without regard to race, color, religion, sex, age, national origin, veteran status, or disability;

NOW, THEREFORE, BE IT RESOLVED, Columbia County Rural Library District prohibits verbal, physical, or visual conduct that belittles or demeans any individual on the basis of race, color, religion, sex, age, national origin, veteran status, or disability.

BE IT FURTHER RESOLVED, Columbia County Rural Library District will administer and conduct all personnel procedures including compensation, benefits, discipline, training, recreational and social activities, and safety and health programs without regard to an individual’s race, color, religion, sex, age, national origin, veteran status, or disability.

RE: FAMILY/MEDICAL LEAVE

Columbia County Rural Library District will comply with all provisions of the Family/ Medical Leave Act of 1993 and other applicable provisions of state leave laws and labor agreements regarding family medical leave in accordance with R.C.W. 49.78

Resolution 2009-5

RE: SEXUAL HARASSMENT: “NO TOLERANCE”

WHEREAS, Columbia County Rural Library District does not tolerate sexual harassment and provides procedures for victims of sexual harassment to report sexual harassment and disciplinary penalties for those who commit sexual harassment; and

WHEREAS, it is the policy of Columbia County Rural Library District to maintain a working environment that is free of any form of harassment related to a person’s sex.

NOW, THEREFORE, BE IT RESOLVED
Columbia County Rural Library District prohibits, forbids, and does not tolerate any employee, manager or visitor, male or female, to harass an employee or non-employee participant in the workplace or to create a hostile or intolerable working environment by exhibiting, committing or encouraging harassment.

Resolution 2009-6

RE: RESOLUTION OF THE COLUMBIA COUNTY RURAL LIBRARY DISTRICT BOARD OF TRUSTEES, COLUMBIA COUNTY, WASHINGTON, ESTABLISHING A LEAVE SHARING POLICY

WHEREAS, the purpose of the leave sharing program is to permit all County Library District employees to provide personal leave to fellow County Library District employees suffering from an illness, injury, or other impairment, who are out of personal leave, floating holiday or compensatory time, and who will, imminently go on leave of absence without pay or terminate County Library District employment;

NOW, THEREFORE, BE IT RESOLVED, by the Columbia County Rural Library District Board of Trustees as follows:

  • Any eligible employee may request personal leave from the leave sharing program;
  • No more than a total of one hundred twenty (120) days of shared leave shall be used during course of employee’s employment with Columbia County Rural Library District;
  • All donations shall be in full days (eight (8) hour day);
  • A maximum of ten days (80 hours) of personal leave, floating holiday, compensatory time, or any combination that does not exceed ten days (80 hours) in a calendar year and does not bring the donor’s personal leave balance below thirteen days (104 hours) may be donated.
  • All donations shall be strictly voluntary;
  • All donations shall be done on the Donation of Personal Leave/Floating Holiday/Compensatory Time form;
  • The donor shall designate the recipient;
  • Once leave has been donated, it becomes the recipient’s leave and shall be entered as personal leave in the recipient’s account, and deducted from the donor’s personal leave, floating holiday or compensatory account.

Resolution 2009-7

RE: RESOLUTION OF THE COLUMBIA COUNTY RURAL LIBRARY DISTRICT BOARD OF TRUSTEES, COLUMBIA COUNTY, WASHINGTON, ESTABLISHING A CARELESSNESS: “NO TOLERANCE” POLICY

WHEREAS, in order to maintain a safe and orderly work environment, Columbia County Rural Library District prohibits and will not tolerate carelessness, substandard, or hazardous work practices within its facility, on its property, or while conducting County Library District business;

NOW, THEREFORE, BE IT RESOLVED, Columbia County Rural Library District expects and requires that its employees perform their employment duties with care and attention to the public’s needs, the safety and welfare of fellow employees, and to the Columbia County Rural Library District quality standards and requirements.

RE: RESOLUTION OF THE COLUMBIA COUNTY RURAL LIBRARY DISTRICT BOARD OF TRUSTEES, COLUMBIA COUNTY, WASHINGTON, ESTABLISHING A SUBSTANCE ABUSE: “NO TOLERANCE” POLICY

WHEREAS, in order to ensure and maintain a drug free workplace, Columbia County Rural Library District; hereby, prohibits and does not tolerate the possession or use of alcohol or illegal drugs at any time when an employee is scheduled to be at work or anywhere within Columbia County Rural Library District facilities or its properties, or in a vehicle (personal or county-owned) that is being used by an employee during work related hours or going to library related functions;

WHEREAS, Columbia County Rural Library District prohibits employees from the unlawful manufacturing, possession, distribution, dispensing, and/or use of alcohol or controlled or illegal substances, including precursor substances defined by RCW 69.50.101 and prohibited drug paraphernalia defined by RCW 69.50.102 during work or on Columbia County Rural Library District’s facilities, properties, or in its vehicles. Employees shall not be impaired, due to drug or alcohol use, from performing expressly stated job duties during assigned working hours. Violators may be subject to immediate disciplinary action, as outlined in Administrative Rules, including, but not limited to termination. Any sale of illegal drugs during work or on the employer’s premises, facilities, or in organization vehicles will be treated as gross misconduct, punishable by immediate discharge for the first offense;

NOW, THEREFORE, BE IT RESOLVED, employees are expected and required to report to work on time and in an appropriate mental and physical condition for work. To do so, employees must not have alcohol or illegal drugs in their system. Violators may be subject to disciplinary action including, but not limited, to termination;

BE IT FURTHER RESOLVED, any employee who is using prescription drugs that may have adverse side effects shall inform their supervisor or Director as soon as possible. Employees are further responsible for disclosing the possible side effects of the drug on work safety or performance and the expected duration of its use.

Resolution 2009-9

RE: RESOLUTION OF THE COLUMBIA COUNTY RURAL LIBRARY DISTRICT BOARD OF TRUSTEES, COLUMBIA COUNTY, WASHINGTON, ESTABLISHING A TOBACCO POLICY

WHEREAS, for health and safety reasons, Columbia County Rural Library District prohibits the use of ALL tobacco by all personnel in County Library District facilities, which include the Dayton Memorial Library building, Delany room, office, and basement areas unless doing so in a designated tobacco area as defined by the Columbia County Rural Library District Board of Trustees.

NOW, THEREFORE, BE IT RESOLVED, smoking will only be allowed during breaks and meal periods in an area where County Library District approved container/s are provided.

Resolution 2009-11

ORDINANCE/RESOLUTION NO. 2009-11
RCW 84.55.120


WHEREAS, the Board of Trustees of Columbia County Rural Library District has met and considered its budget for the calendar year 2010; and

WHEREAS, the Board of Trustees of Columbia County Rural Library District after hearing and after duly considering all relevant evidence and testimony presented, determined that Columbia County Rural Library District requires a regular levy which includes an increase in property tax revenue from the previous year plus amounts resulting from the addition of new construction and improvements to property and any increase in the value of state-assessed property, and amounts authorized by law as a result of any annexations that have occurred and refunds made, in order to discharge the expected expenses and obligations of the district and in its best interest; now, therefore,

BE IT RESOLVED
by the Columbia Country Rural Library District Board of Trustees of Columbia County Rural Library District that an increase in the regular property tax levy is hereby authorized for the 2010 levy in the amount of $1918 which is a percentage increase of 1.1% from the previous year.

This increase is exclusive of additional revenue resulting from the addition of new construction and improvements to property and any increase in the value of state assessed property, and any additional amounts resulting from any annexations that have occurred and refunds made.

Resolution 2009-12

Re: Increasing petty cash change fund for the Columbia County Rural Library District.

WHEREAS, the Columbia County Rural Library District has requested an increase in petty cash fund from $150 to $200 to be established for use in the Dayton Memorial Library; and

WHEREAS, Columbia County Rural Library District staff regularly have the need to make change for customers utilizing the Columbia County Rural Library District Library, requiring immediate access to funds for change; and

WHEREAS, the Columbia County Rural Library District Board of Trustees acknowledge, that at times, it is necessary for Columbia County Rural Library District staff to purchase stamps, pay for other postage, purchase supply items, incur travel expenses and/or other incidental expenditures;

NOW, THEREFORE, BE IT RESOLVED
, by the Columbia County Rural Library District Board of Trustees that said County Library District shall increase its Petty Cash Fund from One Hundred Fifty Dollars ($150.00) to Two Hundred Dollars ($200.00).

BE, IT FURTHER RESOLVED
, that the District Director or Branch Manager shall be Manager of said fund, being responsible to collect all receipts for each and every disbursement and submit said receipts to the Columbia County Auditor at each time of replenishment.

Resolution 2009-13

RE: WHISTLE-BLOWER

WHEREAS, Columbia County Rural Library District is committed to high standards of ethical, moral, and legal conduct and encourages reporting by its employees of improper governmental action taken by Columbia County Rural Library District Library Director, supervisors, employees or Board of Trustees to protect Library District employees who have reported improper Library District actions in accordance with the Library District’s policies and procedures; and

WHEREAS, “Improper District Action” means any action by a Library District Officer or employee that is undertaken in the performance of an officer’s or employee’s official duties, whether or not any alleged hate action is to have been committed within the scope of the employee’s employment; and that (1) is in violation of any federal, state, or local law or rule; (2) is an abuse of authority; (3) is of substantial and specific danger to the public health or safety; or (4) is a gross waste of public funds.

NOW, THEREFORE, BE IT RESOLVED, “Improper District Action” does not include personnel actions, including employee grievances, complaints, appointments, promotions, transfers, assignments, reassignments, reinstatements, restorations, re-employment, performance evaluations, reductions in pay, dismissals, suspensions, demotions, or reprimands.

BE IT FURTHER RESOLVED, No employee, District Director, or Library District Board of Trustee will be retaliated against as a result of reporting an “improper district action.”
